PUBLIC OFFER (CONTRACT) FOR THE PROVISION OF SERVICES USING THE ASTROCLARITY CHATBOT

This Public Offer (hereinafter referred to as the “Agreement”) is made by FOP Litvinova Maryna, EDRPOU code 3180516363, registered at 63738, Ukraine, Kharkiv region, Kup’yansk, Kivsharivka village, 60/72 (hereinafter referred to as the “Provider”), and any individual or entity (hereinafter referred to as the “Customer”) who accepts this offer by using the AstroClarity chatbot.

1. Parties to the Agreement

This Public Offer (hereinafter referred to as the “Agreementˮ) is made by FOP Litvinova Maryna, EDRPOU code 3180516363, registered at 63738, Ukraine, Kharkiv region, Kupʼyansk, Kivsharivka village, 60/72 (hereinafter referred to as the “Providerˮ), and any individual or entity (hereinafter referred to as the “Customerˮ) who accepts this offer by using the AstroClarity chatbot.

2. Acceptance of the Offer

2.1. This Agreement is considered accepted by the Customer upon the commencement of using the AstroClarity chatbot located at https://t.me/AstroClarity_bot or any other chatbots, that are presented by this website (hereinafter referred to as the “Chatbotˮ).

2.2. By accepting this Agreement, the Customer agrees to all its terms without any exceptions or limitations.

3. Subject of the Agreement

The Provider agrees to render astrological, numerological, and feng shui calculation services (hereinafter referred to as the “Servicesˮ) to the Customer through the Chatbot, and the Customer agrees to accept and pay for the Services under the terms of this Agreement.

4. Description of Services 4.1. Services Provided:

Collection of the Customerʼs input data, including date, time, and place of birth.

Processing of the provided data using the OpenAI assistant integrated within the Chatbot.

Delivery of personalized astrological, numerological, and feng shui calculations to the Customer via the Chatbot.

4.2. Service Delivery Method:
The Customer interacts with the Chatbot to provide the necessary input data.

The Chatbot processes the data in real-time and delivers the results directly within the chat interface.

4.3 Service Availability:

The Services are available 24/7, subject to technical maintenance and unforeseen interruptions.

5. Terms of Service Provision
5.1.
The Customer must provide accurate and complete information for the proper

provision of Services.

5.2. The Services are intended for personal use only. Redistribution or commercial use of the results is prohibited without prior written consent from the Provider.

5.3. The Customer acknowledges that the Services are based on interpretations and are for informational purposes only.

6. Payment Conditions

6.1. Pricing Options:

One-time payment: Access to one set of Services after payment.

- $1 (or 42 UAH)* - receiving the first detailed personality characteristics based on the calculations of the Astrology, Numerology and Feng Shui systems based on the date, time and place of birth.

*Payment is made in Ukrainian currency (hryvnia, UAH). The exact cost in hryvnia will be calculated at the UAH/USD exchange rate at the time of payment and will be shown on the details entry page before payment.*

- $2 (or 84 UAH)* - “3 in 1” package - includes a detailed analysis of the topics “Money and Wealth”, “Relationships” and “Forecast for 2025”

*Payment is made in Ukrainian currency (hryvnia, UAH). The exact cost in hryvnia will be calculated at the UAH/USD exchange rate at the time of payment and will be displayed on the details entry page until the payment is made.*

Monthly subscription: Additional access to the Services for a monthly fee.

- $3 (or 126 UAH)* - monthly subscription to receive a weekly personal forecast (according to astrology and numerology) for the previously specified date, time and place of birth.

6.2. Payment Process:
Payments are made in the currency specified within the Chatbot.

The Customer selects the desired service option and is directed to a secure payment gateway provided by third-party payment processors.

6.3. Payment Methods:
Accepted payment methods may include credit/debit cards, electronic wallets,

and other methods as specified in the Chatbot.

All payment processing is handled by third-party providers. The Provider does not store or process payment card details.

6.4. Invoices and Receipts:
Upon successful payment, the Customer will receive a confirmation message

within the Chatbot.
Receipts or invoices can be requested by contacting the Provider at
clarityastro@gmail.com.

6.5. Payment Obligations:

The Customer is responsible for ensuring that payments are completed successfully.

Failure to pay may result in suspension or termination of access to the Services.

7. Refund Policy
7.1. Eligibility for Refunds:

• Refunds are generally not provided due to the digital and personalized nature of the Services.

• Exceptions may be made in cases of technical errors or duplicate payments.

7.2. Refund Request Process:
• The Customer must submit a refund request within 7 days of the transaction

by emailing clarityastro@gmail.com.
• The request should include the transaction details and the reason for the

refund.

7.3. Refund Decision:
• Refunds are issued at the sole discretion of the Provider after reviewing the

request.

• Approved refunds will be processed within 14 business days using the original payment method.

8. Rights and Obligations of the Parties

8.1. Providerʼs Rights and Obligations Obligations:

  • Provide the Services as described in this Agreement.

  • Ensure the confidentiality and security of the Customerʼs personal data.

  • Notify the Customer of any changes to the terms of this Agreement.

    Rights:

  • Modify or update the Services and pricing.

• Suspend or terminate the Customerʼs access in case of breach of this Agreement.

8.2. Customerʼs Rights and Obligations Obligations:

  • Provide accurate and truthful information.

  • Comply with the terms of this Agreement and any applicable laws.

  • Respect the intellectual property rights of the Provider.

    Rights:

  • Access and use the Services upon payment.

  • Receive support by contacting the Provider.

    9. Limitation of Liability

    9.1. The Provider is not liable for any indirect, incidental, or consequential damages arising from the use of the Services.

    9.2. The Provider does not guarantee the accuracy, completeness, or suitability of the Services for any particular purpose.

    9.3. The Customer uses the Services at their own risk.

    10. Confidentiality and Data Protection

    10.1. The Provider processes personal data in accordance with the Privacy Policy available at Privacy Policy page.

    10.2. The Customer consents to the processing of their personal data for the purpose of providing the Services.

    11. Intellectual Property Rights

    11.1. All content, trademarks, and data on the Chatbot, including but not limited to software, databases, text, graphics, and icons, are the property of the Provider.

11.2. Unauthorized use, reproduction, or distribution of the Providerʼs intellectual property is prohibited.

12. Amendments to the Agreement

12.1. The Provider reserves the right to amend the terms of this Agreement at any time.

12.2. Any changes will be effective upon posting the updated Agreement within the Chatbot or on the Providerʼs website.

12.3. Continued use of the Services after changes constitutes acceptance of the new terms.

13. Governing Law and Dispute Resolution

13.1. This Agreement shall be governed by and construed in accordance with the laws of Ukraine.

13.2. Any disputes shall be resolved through negotiations. If unresolved, disputes will be submitted to the competent courts of Ukraine.

14. Term and Termination

14.1. This Agreement is effective upon acceptance and remains in force until terminated.

14.2. The Customer may terminate this Agreement by ceasing to use the Services.

14.3. The Provider may terminate this Agreement or suspend Services without prior notice in case of the Customerʼs breach of the Agreement.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, or governmental restrictions.

16. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.

17. Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the subject matter and supersedes all prior agreements.
